These Terms of Service (“Terms”) govern your use of the Lobster mobile app and the uselobster.app website, operated by SyncStream Software(“we”, “us”, “our”). By accessing or using our services you agree to these Terms.
You must be at least 13 years old (or 16 in the EU) to use Lobster. By using our services you represent that you meet this requirement. If you are using Lobster on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@uselobster.app if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
You agree not to:
Lobsterallows you to store personal fitness data, including progress photos, body measurements, and workout logs (“Your Content”). You retain full ownership of Your Content.
By storing Your Content in Lobster you grant us a limited, non-exclusive licence to store and process it solely for the purpose of providing the service to you. We do not use Your Content for advertising and do not share it with third parties except as described in our Privacy Policy.
You can delete Your Content or your entire account at any time from within the app. Upon deletion we will remove your data from our systems promptly.
The Lobster app, website, logo, and all associated content — excluding Your Content — are the property of SyncStream Software and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our materials without our prior written consent.
We welcome feedback and suggestions. If you send us ideas, we may use them without any obligation to you.
Lobster is a fitness tracking tool and is provided for informational and motivational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any exercise or diet programme.
The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, SyncStream Software and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or goodwill — arising from your use of, or inability to use, the service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $50 USD.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which SyncStream Software is incorporated, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction there.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes we will notify you by email or by displaying a prominent notice in the app. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
